3. General Information Only

Unless an applicable Contract expressly states otherwise, information published by BhavPro is provided for general business, educational, informational or illustrative purposes.

It is not automatically tailored to:

  • your organisation;

  • your legal obligations;

  • your financial position;

  • your tax position;

  • your technical architecture;

  • your security risk;

  • your advertising account;

  • your customer base;

  • your industry;

  • or your commercial objectives.

A public article, guide, calculator, landing page, advertisement, presentation or social-media post should therefore not be treated as a substitute for a properly scoped professional engagement.

4. No Guarantee of Business Results

Business outcomes depend on many variables.

BhavPro does not generally guarantee:

  • revenue growth;

  • profit;

  • sales;

  • leads;

  • conversion rates;

  • return on investment;

  • return on advertising spend;

  • search rankings;

  • website traffic;

  • reduced costs;

  • increased productivity;

  • market share;

  • subscriber growth;

  • customer acquisition;

  • customer retention;

  • recruitment success;

  • campaign approval;

  • account approval;

  • or another commercial result,

unless a specific written Contract expressly creates that guarantee.

Where a target, forecast, benchmark or expected outcome is stated, it is normally a planning assumption or objective rather than a contractual warranty.

5. Past Performance Does Not Guarantee Future Results

Case studies, examples, historical results, portfolio information and previous campaign performance may demonstrate what happened in a particular situation.

They do not guarantee that another customer will achieve:

  • the same result;

  • a proportional result;

  • a minimum result;

  • or any particular commercial outcome.

Results vary because of factors including:

  • industry;

  • market conditions;

  • competition;

  • pricing;

  • offer strength;

  • website quality;

  • brand recognition;

  • audience;

  • location;

  • budget;

  • internal sales capability;

  • customer service;

  • product demand;

  • economic conditions;

  • advertising platform changes;

  • algorithm changes;

  • tracking restrictions;

  • timing;

  • and execution outside BhavPro’s control.

6. Case Studies

Where BhavPro publishes a case study, it may include:

  • historical facts;

  • customer-approved information;

  • campaign metrics;

  • before/after comparisons;

  • observations;

  • strategic conclusions;

  • or illustrative results.

A case study should be interpreted in its stated context.

Unless expressly stated:

  • results are not typicality guarantees;

  • the conditions may not be reproducible;

  • external factors may have contributed;

  • and the case study is not a promise of future performance.

BhavPro aims to maintain appropriate evidence for objective factual claims made in advertising or marketing.

7. Testimonials and Reviews

Testimonials and reviews reflect the experience or opinion of the person or organisation providing them.

They do not necessarily represent:

  • the experience of every customer;

  • an objective performance guarantee;

  • a statistically representative outcome;

  • or independent proof of every factual claim contained in the testimonial.

Where a testimonial is used in marketing, BhavPro aims to retain appropriate evidence that it is genuine.

A testimonial does not turn an otherwise unsupported objective marketing claim into a substantiated claim.

8. Advertising Claims

A disclaimer cannot cure a materially misleading advertisement.

BhavPro’s policy is that objective advertising claims should be supported by appropriate evidence before publication.

Examples include:

  • “number one”;

  • “best”;

  • “leading”;

  • “fastest”;

  • “cheapest”;

  • quantified savings;

  • quantified performance improvements;

  • guaranteed leads;

  • guaranteed rankings;

  • comparative claims;

  • certifications;

  • accreditations;

  • customer numbers;

  • market share;

  • award claims;

  • and price claims.

Where a claim depends on qualifications, conditions or assumptions, those should be disclosed with sufficient prominence where required.

Small print should not contradict the overall impression of an advertisement.

Business Strategy and Consulting

9. Strategy Recommendations

Business strategy recommendations are based on:

  • information available at the time;

  • assumptions;

  • customer-supplied data;

  • market observations;

  • professional judgement;

  • and the scope of the engagement.

Business decisions involve risk.

BhavPro cannot guarantee that implementing a recommendation will produce a specified commercial outcome.

The Customer remains responsible for deciding whether a recommendation is appropriate for its circumstances unless responsibility is expressly allocated differently in a Contract.

10. Operational Improvement

Recommendations concerning:

  • processes;

  • workflows;

  • SOPs;

  • staffing;

  • automation;

  • systems;

  • CRM;

  • reporting;

  • technology;

  • sales;

  • marketing;

  • or organisational design

can affect existing operations.

Before implementing a material change, the Customer should consider:

  • dependencies;

  • employee impact;

  • training;

  • data integrity;

  • compliance;

  • security;

  • backups;

  • continuity;

  • and rollback requirements.

A recommendation to improve efficiency is not a guarantee that every organisation will achieve the same saving or productivity gain.

11. Financial and Commercial Projections

Budgets, forecasts, financial models, ROI calculations, cost estimates and commercial projections may depend on assumptions.

Examples include:

  • expected conversion rates;

  • expected traffic;

  • average order value;

  • expected lead value;

  • sales close rate;

  • advertising costs;

  • staffing costs;

  • software costs;

  • churn;

  • or implementation time.

Actual outcomes may differ materially.

Unless expressly agreed as a regulated service, BhavPro does not provide regulated investment advice or financial advice.

12. Accounting and Tax Information

Information concerning:

  • VAT;

  • invoicing;

  • expenses;

  • accounting workflows;

  • finance operations;

  • or tax-related systems

may be provided for operational or system-design purposes.

BhavPro is not acting as your accountant or tax adviser unless that role is expressly agreed and legally appropriate.

You should obtain advice from a qualified accountant or tax professional where required.

Advertising and Paid Media

13. General Paid Advertising Disclaimer

Paid advertising performance is influenced by factors including:

  • platform auctions;

  • bidding;

  • budget;

  • advertiser competition;

  • audience size;

  • creative quality;

  • offer quality;

  • landing-page quality;

  • conversion tracking;

  • platform learning;

  • seasonality;

  • geography;

  • product demand;

  • customer reputation;

  • consumer behaviour;

  • and policy restrictions.

BhavPro cannot normally guarantee:

  • ad approval;

  • impressions;

  • clicks;

  • lead volume;

  • cost per click;

  • cost per lead;

  • cost per acquisition;

  • conversions;

  • revenue;

  • ROAS;

  • or profitability.

Any quoted target should be interpreted as a target, benchmark or planning assumption unless expressly guaranteed in writing.

14. Advertising Budgets

An advertising budget is an amount allocated to media.

It does not guarantee:

  • full spending;

  • exact daily spending;

  • an exact number of impressions;

  • an exact number of leads;

  • or a particular commercial return.

Advertising platforms may:

  • underspend;

  • overspend within their permitted billing rules;

  • shift spend between dates;

  • alter auction prices;

  • or change delivery.

Media Spend is separate from BhavPro professional Fees unless expressly stated otherwise.

15. Advertising Forecasts

Forecasting tools supplied by advertising platforms or BhavPro may estimate:

  • traffic;

  • search demand;

  • impressions;

  • clicks;

  • cost;

  • conversions;

  • audience size;

  • or other performance.

Forecasts can change and should not be treated as guarantees.

They may be affected by:

  • competitors;

  • auction changes;

  • platform models;

  • consent limitations;

  • browser privacy changes;

  • tracking loss;

  • demand changes;

  • and live campaign behaviour.

16. Google Ads

Google controls the Google Ads platform.

BhavPro does not control:

  • Google’s advertising policies;

  • auction mechanics;

  • Quality Score systems;

  • automated bidding;

  • advertiser verification;

  • ad review;

  • account suspension;

  • keyword matching;

  • invalid traffic detection;

  • audience availability;

  • consent functionality;

  • or platform changes.

Google may reject, limit or suspend an advertisement or account.

BhavPro cannot guarantee that Google will approve or continue to serve a campaign.

Google Ads destinations must also satisfy Google’s current destination and misrepresentation requirements. A BhavPro recommendation or campaign setup does not guarantee that Google will consider a destination compliant.

17. Meta / Facebook / Instagram Advertising

Meta controls Facebook and Instagram advertising infrastructure.

BhavPro does not control:

  • Meta’s ad review;

  • account restrictions;

  • business verification;

  • advertising policies;

  • audience availability;

  • automated optimisation;

  • auction prices;

  • delivery;

  • or account suspension.

Meta can alter or withdraw features without BhavPro’s control.

BhavPro cannot guarantee Meta campaign approval, account continuity or performance.

18. Microsoft Advertising / Bing Ads

Microsoft controls the Microsoft Advertising/Bing platform.

BhavPro cannot guarantee:

  • approval;

  • delivery;

  • audience availability;

  • CPC;

  • conversion volume;

  • Microsoft account availability;

  • UET operation;

  • or policy outcomes.

Microsoft may change:

  • advertising policies;

  • bidding systems;

  • account rules;

  • consent requirements;

  • targeting;

  • or platform functionality.

19. LinkedIn Advertising

LinkedIn controls its advertising services and business-account rules.

BhavPro does not guarantee:

  • ad approval;

  • inventory;

  • campaign reach;

  • lead volume;

  • lead quality;

  • cost per lead;

  • Insight Tag operation;

  • matched audience size;

  • or account availability.

LinkedIn audience costs can vary substantially depending on market, geography, seniority, sector and competition.

20. Other Advertising Platforms

The same general principles apply where BhavPro works with another third-party advertising platform.

The platform can:

  • change rules;

  • change prices;

  • suspend access;

  • change data availability;

  • remove functionality;

  • or reject advertisements.

BhavPro is not the operator of those platforms.

21. Advertising Platform Suspensions

A platform may suspend or restrict an account because of:

  • policy enforcement;

  • verification;

  • billing;

  • advertiser identity;

  • landing page;

  • product restrictions;

  • suspicious activity;

  • automated systems;

  • previous account history;

  • or another platform concern.

BhavPro can provide reasonable assistance where included in scope, but cannot compel a platform to reinstate an account.

A platform suspension does not, by itself, prove that BhavPro breached its Contract.

22. Advertising Account Verification

Advertising platforms increasingly require:

  • identity verification;

  • business verification;

  • beneficial ownership information;

  • payment verification;

  • regulatory credentials;

  • or domain verification.

The Customer is responsible for providing accurate information and required documents.

BhavPro cannot guarantee successful verification.

23. Advertising Lead Quality

A recorded advertising lead is not necessarily:

  • a genuine buyer;

  • qualified;

  • contactable;

  • financially able to buy;

  • or ready to purchase.

Advertising campaigns may generate:

  • low-intent enquiries;

  • mistaken enquiries;

  • duplicates;

  • spam;

  • bots;

  • competitors;

  • recruiters;

  • suppliers;

  • or fraudulent submissions.

Lead quality depends partly on targeting, offer, form design, market and the Customer’s qualification process.

24. Invalid Clicks, Bots and Fraud

Digital advertising may encounter:

  • invalid clicks;

  • bots;

  • fraudulent impressions;

  • click farms;

  • automated form submissions;

  • competitor clicks;

  • or other invalid activity.

Advertising platforms operate their own invalid-traffic systems.

BhavPro can use reasonable safeguards and reporting but cannot guarantee that every invalid interaction will be detected or reimbursed.

SEO and Search

25. General SEO Disclaimer

Search engine optimisation is affected by systems controlled by third parties, including Google, Bing and other search engines.

BhavPro cannot guarantee:

  • a particular ranking position;

  • page-one visibility;

  • a featured snippet;

  • an AI overview citation;

  • inclusion in a search index;

  • a specific volume of organic traffic;

  • or a particular number of organic leads.

SEO is a process of improving technical, content, relevance, authority and user-experience signals; it is not a mechanism that gives BhavPro control over search results.

26. Search Ranking Changes

Rankings can change because of:

  • search-engine algorithm updates;

  • competitor activity;

  • new content;

  • changes to the Customer website;

  • technical problems;

  • crawling/indexing changes;

  • backlinks;

  • reputation;

  • search demand;

  • user location;

  • personalisation;

  • language;

  • device;

  • search intent;

  • and other factors.

A ranking observed at one time, location or device is not guaranteed to be identical elsewhere.

27. Google Search

Google controls:

  • indexing;

  • ranking;

  • Search Console data;

  • crawling;

  • rendering;

  • snippets;

  • structured-data eligibility;

  • rich results;

  • AI-generated search features;

  • and manual or algorithmic actions.

BhavPro cannot force Google to index, rank or display a page.

Submitting a sitemap, requesting indexing or implementing structured data does not guarantee inclusion or enhanced presentation.

28. Bing and Other Search Engines

The same limitations apply to Microsoft Bing and other search engines.

Search engines may independently:

  • crawl;

  • index;

  • classify;

  • rank;

  • rewrite titles;

  • select snippets;

  • or exclude content.

29. Keyword Research

Keyword volume and competition metrics are estimates derived from tools, advertising platforms or third-party datasets.

These figures can:

  • be rounded;

  • be sampled;

  • be delayed;

  • vary by provider;

  • or differ from actual search activity.

Keyword selection should therefore be treated as a strategic decision informed by data, not guaranteed demand.

30. Ranking Reports

Ranking reports are point-in-time measurements.

Differences can occur because of:

  • location;

  • browser;

  • account history;

  • search engine;

  • device;

  • language;

  • data centre;

  • personalised results;

  • or the reporting provider.

A ranking report should not be interpreted as evidence that every user sees the same result.

31. Traffic Estimates

Traffic tools can estimate site visits, keyword traffic or competitor traffic.

Unless the data comes from the Customer’s own verified analytics or server records, third-party traffic estimates may be materially different from actual traffic.

32. Backlinks and Off-Site Factors

Third-party websites control whether they:

  • link;

  • remove links;

  • alter content;

  • add nofollow;

  • change URLs;

  • block access;

  • or close.

BhavPro cannot guarantee the permanence of an independently controlled backlink.

BhavPro does not endorse manipulative link schemes that breach applicable search-engine policies.

33. Search Algorithm Updates

Search engines can release:

  • core updates;

  • spam updates;

  • content-system updates;

  • ranking-system changes;

  • or other algorithm changes.

These can improve or reduce visibility even where a website has not changed.

Unless the Contract expressly provides otherwise, algorithm volatility does not constitute a guarantee or warranty failure by BhavPro.

34. AI Search, AEO and Generative Search

AI-assisted search engines and generative answer systems may:

  • cite websites;

  • summarise pages;

  • omit websites;

  • hallucinate information;

  • combine multiple sources;

  • or change attribution mechanisms.

BhavPro cannot guarantee:

  • inclusion in an AI answer;

  • a citation;

  • answer prominence;

  • brand mention;

  • answer accuracy;

  • or referral traffic.

AEO and generative-search optimisation are evolving practices.

Content and Social Media

35. Content Marketing

Content performance depends on:

  • search demand;

  • promotion;

  • relevance;

  • quality;

  • distribution;

  • competition;

  • authority;

  • timing;

  • platform algorithms;

  • and audience interest.

Publishing content does not guarantee traffic, links, leads or rankings.

36. Social Media

Social networks control:

  • organic reach;

  • algorithms;

  • advertising;

  • account moderation;

  • account suspension;

  • post visibility;

  • audience recommendations;

  • and engagement distribution.

BhavPro does not guarantee the reach or performance of social content.

37. Followers, Engagement and Virality

No responsible marketing provider can guarantee that content will:

  • go viral;

  • receive a specific number of shares;

  • gain a particular number of followers;

  • or generate a specific engagement rate,

unless the metric is directly purchased or contractually defined in a lawful and transparent manner.

BhavPro does not endorse fake followers, fake reviews or fabricated engagement.

Email Marketing and B2B Outreach

38. Email Marketing Results

Email campaign results depend on:

  • list quality;

  • permission;

  • reputation;

  • sender domain;

  • deliverability;

  • content;

  • subject line;

  • audience;

  • timing;

  • inbox filtering;

  • and recipient interest.

BhavPro does not guarantee:

  • inbox placement;

  • open rates;

  • click rates;

  • response rates;

  • leads;

  • or sales.

39. Email Deliverability

An email being accepted by an SMTP provider does not necessarily mean that:

  • it reached an inbox;

  • it avoided spam;

  • it was read;

  • or it was received by a human.

Email providers independently operate filtering and reputation systems.

40. Open Tracking

Open tracking can be unreliable because:

  • image loading may be blocked;

  • privacy features may preload images;

  • security scanners may trigger requests;

  • or client software may proxy images.

An “open” event should therefore not always be interpreted as proof that an individual personally read an email.

Where tracking technology is used, applicable privacy and PECR requirements also apply.

41. Click Tracking

Automated security scanners can click links.

A click event may therefore not always represent conscious human engagement.

Important business decisions should not rely solely on a single tracking event.

42. B2B Prospecting

B2B prospecting results vary according to:

  • market;

  • role;

  • relevance;

  • list quality;

  • timing;

  • proposition;

  • sender reputation;

  • legal eligibility;

  • and recipient interest.

BhavPro does not guarantee meetings, replies, opportunities or sales.

43. Purchased and Third-Party Data

Third-party data can be:

  • inaccurate;

  • outdated;

  • duplicated;

  • incorrectly classified;

  • or unlawfully sourced.

A data supplier’s statement that a list is “compliant” is not itself a guarantee that BhavPro or the Customer may use the data for every intended campaign.

Appropriate due diligence remains necessary.

Analytics, Attribution and Measurement

44. Analytics Data

Analytics systems can be affected by:

  • browser privacy controls;

  • cookie choices;

  • consent;

  • ad blockers;

  • script errors;

  • device switching;

  • cross-domain journeys;

  • offline conversion;

  • multiple users;

  • attribution settings;

  • data sampling;

  • and platform modelling.

Analytics should therefore be interpreted as measurement evidence, not perfect factual reconstruction of every user journey.

45. Attribution Models

Different attribution models can assign credit differently.

Examples include:

  • first click;

  • last click;

  • data-driven attribution;

  • position-based;

  • time-decay;

  • platform-reported attribution;

  • or internal CRM attribution.

Two platforms may both claim the same conversion.

BhavPro does not warrant that every attribution source will agree.

46. Advertising Platform Reporting

Google, Meta, Microsoft, LinkedIn and other platforms may use their own:

  • attribution windows;

  • modelling;

  • identity matching;

  • view-through conversion rules;

  • click-through conversion rules;

  • and reporting delays.

Platform totals may therefore differ from:

  • CRM records;

  • Stripe;

  • website analytics;

  • server logs;

  • or another advertising platform.

47. Conversion Tracking

Conversion tracking can fail or under-report because of:

  • denied consent;

  • blocked scripts;

  • browser privacy;

  • tracking prevention;

  • technical errors;

  • account configuration;

  • cross-device use;

  • or third-party API changes.

It can also over-report because of:

  • duplicate events;

  • repeated page loads;

  • testing;

  • incorrect triggers;

  • or attribution overlap.

BhavPro aims to implement reasonable validation but cannot guarantee mathematically perfect attribution.

48. Revenue Attribution

A platform-reported revenue figure does not necessarily mean the platform solely caused that revenue.

A customer can have multiple touchpoints, including:

  • organic search;

  • direct visits;

  • referrals;

  • email;

  • social;

  • paid advertising;

  • sales calls;

  • offline activity;

  • and repeat business.

ROAS and ROI decisions should consider the selected attribution methodology.

49. Dashboards and Reports

Dashboards can contain:

  • source data;

  • calculated metrics;

  • transformations;

  • delayed feeds;

  • cached values;

  • estimates;

  • and third-party reporting.

A dashboard should not be treated as an audited financial statement unless expressly identified as such.

Where a material decision depends on a figure, the underlying source should be verified where appropriate.

Conversion Rate Optimisation

50. CRO and Testing

A/B tests and CRO experiments are influenced by:

  • sample size;

  • statistical significance;

  • traffic quality;

  • seasonality;

  • novelty;

  • segmentation;

  • concurrent campaigns;

  • and implementation quality.

An apparent uplift in a limited test may not persist indefinitely.

BhavPro does not guarantee a particular conversion uplift.

51. Statistical Significance

A test result can be misleading when:

  • sample sizes are too small;

  • experiments are stopped early;

  • multiple tests overlap;

  • or statistical methodology is unsuitable.

Where statistical significance is discussed, it should be interpreted according to the methodology used.

Artificial Intelligence

52. General AI Disclaimer

AI systems can generate outputs that are:

  • incorrect;

  • incomplete;

  • outdated;

  • biased;

  • inconsistent;

  • fabricated;

  • or unsuitable for a particular purpose.

AI-generated output should not automatically be treated as verified fact.

53. AI Hallucinations

Generative AI can produce plausible but incorrect:

  • facts;

  • citations;

  • laws;

  • statistics;

  • product information;

  • technical details;

  • code;

  • calculations;

  • or recommendations.

Where accuracy matters, outputs should be independently checked.

54. AI-Assisted Content

AI may assist with:

  • drafts;

  • summaries;

  • outlines;

  • research organisation;

  • code assistance;

  • campaign ideas;

  • or internal recommendations.

Human review may still be required for:

  • factual accuracy;

  • tone;

  • intellectual property;

  • regulatory compliance;

  • brand requirements;

  • and suitability.

55. AI Search and Recommendation Systems

AI platforms can change:

  • models;

  • output behaviour;

  • training data;

  • citations;

  • ranking;

  • retrieval;

  • and safety policies.

BhavPro does not control those third-party systems.

56. Automated Decisions

Unless expressly stated otherwise, AI assistance provided by BhavPro is not intended to be the sole basis for decisions with legal or similarly significant effects on individuals.

Where a regulated or high-impact decision is required, appropriate human and professional review should be used.

57. AI and Confidential Information

Customers should not provide unnecessary sensitive or confidential information to a general AI interface.

Where BhavPro implements an AI workflow, the applicable Contract and privacy arrangements determine:

  • provider;

  • data scope;

  • security;

  • retention;

  • access;

  • and permitted use.

No AI system should be assumed to provide absolute confidentiality merely because it is technically convenient.

Website and Software Development

58. Software Is Not Error-Free

Software, websites, integrations and automation can contain defects.

Reasonable testing reduces risk but cannot guarantee that software will:

  • contain no defects;

  • work with every environment;

  • never fail;

  • or remain compatible indefinitely.

59. Browser Compatibility

Browsers and devices change.

A website tested successfully at launch may later be affected by:

  • browser updates;

  • operating-system updates;

  • JavaScript changes;

  • CSS changes;

  • extension behaviour;

  • or device-specific issues.

Ongoing compatibility support is included only where stated in the applicable Contract.

60. WordPress and Plugin Changes

WordPress, themes and plugins can update independently.

Updates can:

  • alter APIs;

  • introduce incompatibility;

  • change database structures;

  • change security requirements;

  • or remove deprecated functionality.

A previously working implementation may require future maintenance.

61. Third-Party APIs

APIs may:

  • change;

  • be deprecated;

  • become paid;

  • impose new limits;

  • change authentication;

  • remove endpoints;

  • or become unavailable.

BhavPro cannot guarantee permanent third-party API compatibility.

62. Integrations

An integration depends on multiple systems.

A failure can occur because of:

  • credentials;

  • source data;

  • network conditions;

  • API limits;

  • third-party outages;

  • changed schemas;

  • permissions;

  • or rate limits.

An integration project cannot eliminate all external dependency risk.

63. Data Migration

Data migration depends on the quality of source data.

Problems may include:

  • duplicates;

  • invalid values;

  • missing fields;

  • inconsistent formatting;

  • orphaned relationships;

  • unsupported legacy structures;

  • or corrupt exports.

BhavPro can use validation and reconciliation but cannot guarantee that poor source data contains enough evidence to infer missing facts safely.

Cybersecurity and IT

64. No System Is Completely Secure

No website, server, network, device, cloud service or software environment can be guaranteed to be completely secure.

Security controls reduce risk but cannot eliminate all risk.

65. Security Assessments

A security review or audit is normally:

  • point-in-time;

  • scope-limited;

  • dependent on available evidence;

  • and subject to the techniques used.

A system that passes a review can later become vulnerable because of:

  • configuration changes;

  • new vulnerabilities;

  • new attack techniques;

  • leaked credentials;

  • third-party compromise;

  • or user actions.

66. Vulnerability Scanning

Automated vulnerability scanners can produce:

  • false positives;

  • false negatives;

  • incomplete findings;

  • or findings requiring manual validation.

A clean automated scan is not proof that a system has no vulnerabilities.

67. Cybersecurity Recommendations

Security recommendations may involve trade-offs between:

  • usability;

  • compatibility;

  • cost;

  • resilience;

  • and risk.

The Customer remains responsible for determining its acceptable risk unless BhavPro has expressly assumed a defined managed-security responsibility.

68. Backups

A backup is useful only if it:

  • exists;

  • is complete;

  • is protected;

  • and can be restored.

Where backup responsibility belongs to the Customer or hosting provider, BhavPro cannot guarantee restoration.

Even where BhavPro manages backups, the applicable service level and retention govern the obligation.

69. Incident Response

No provider can guarantee that a cyber incident will never occur.

Incident response aims to:

  • detect;

  • contain;

  • investigate;

  • restore;

  • and learn.

Its success depends on the nature and timing of the incident.

Hosting, Availability and Cloud Services

70. Hosting Availability

Internet services can experience outages.

BhavPro does not promise 100% availability unless an applicable Contract expressly creates a specific service-level commitment.

71. Third-Party Infrastructure

Hosting, DNS, CDN, email, cloud, payment and telecommunications services can fail independently.

BhavPro may assist where included in scope but cannot control the infrastructure of an independent provider.

72. Performance

Website speed can depend on:

  • hosting;

  • network location;

  • browser;

  • plugins;

  • scripts;

  • images;

  • advertising tags;

  • user device;

  • CDN;

  • traffic;

  • and third-party services.

Performance measurements vary by methodology and testing conditions.

VoIP, Telecoms and Communications

73. VoIP and Communications

VoIP and cloud communications rely on:

  • internet connectivity;

  • carrier networks;

  • hardware;

  • power;

  • DNS;

  • routing;

  • and provider availability.

Call quality and availability can vary.

74. Emergency Calling

Where a VoIP or communications product supports emergency calling, the Customer must follow the provider’s specific emergency-call configuration and location requirements.

Cloud telephony should not be assumed to operate identically to a traditional fixed telephone service during:

  • power loss;

  • broadband failure;

  • or provider outage.

75. Number Porting

Number porting depends on telecommunications providers.

Port dates, rejection, losing-provider information and validation are not entirely controlled by BhavPro.

Recruitment and Workforce Services

76. Recruitment Outcomes

Recruitment services can improve sourcing and screening but do not guarantee:

  • a hire;

  • candidate acceptance;

  • employee performance;

  • retention;

  • availability;

  • or suitability beyond the agreed assessment process.

The Customer remains responsible for final hiring decisions unless expressly agreed otherwise.

77. Candidate Information

CVs, references and candidate statements can contain errors or omissions.

Where a Customer requires formal:

  • background checks;

  • qualification verification;

  • right-to-work checks;

  • criminal-record checks;

  • or regulatory screening,

these must be expressly included and carried out through appropriate processes.

Legal, Regulatory and Compliance Information

78. Not Legal Advice

Unless expressly stated and provided by an appropriately qualified professional, BhavPro does not provide legal advice.

Information about:

  • UK GDPR;

  • PECR;

  • contracts;

  • advertising compliance;

  • privacy;

  • cookies;

  • consumer law;

  • employment;

  • or regulation

is intended to support business understanding and implementation planning.

You should obtain legal advice where your decision requires formal legal interpretation.

79. No Regulatory Certification

A BhavPro audit, checklist or recommendation does not automatically mean that a business is:

  • “GDPR certified”;

  • legally compliant;

  • cybersecurity certified;

  • advertising compliant;

  • tax compliant;

  • or regulator-approved.

Compliance depends on the organisation’s complete factual circumstances and ongoing behaviour.

80. Advertising Standards Compliance

BhavPro seeks to create advertising consistent with applicable requirements, but responsibility can depend on:

  • who supplied the claim;

  • who approved the advertisement;

  • the product;

  • the target audience;

  • sector-specific rules;

  • and the final published destination.

A disclaimer must not be used to contradict a misleading headline or omit material information.

81. Regulated Industries

Additional restrictions can apply to industries such as:

  • financial services;

  • healthcare;

  • legal services;

  • gambling;

  • alcohol;

  • pharmaceuticals;

  • recruitment;

  • housing;

  • credit;

  • political advertising;

  • and other regulated sectors.

A general BhavPro marketing service does not automatically include specialist regulatory approval for a regulated industry.

Calculators, Audits, Tools and Assessments

82. Online Calculators

BhavPro may provide calculators for:

  • cost;

  • savings;

  • ROI;

  • growth;

  • audits;

  • maturity scoring;

  • or other business estimates.

Calculator outputs depend entirely on:

  • inputs;

  • assumptions;

  • formula;

  • data quality;

  • and model design.

They are estimates unless explicitly described otherwise.

83. Audit Scores

An online audit or assessment score is usually:

  • diagnostic;

  • indicative;

  • and based on the questions or signals evaluated.

It is not necessarily a complete professional audit.

84. Automated Website Audits

Automated audits can identify technical signals but may not capture:

  • business context;

  • content quality;

  • legal compliance;

  • nuanced UX;

  • security architecture;

  • commercial strategy;

  • or all technical defects.

Manual review may be required.

85. Recommendations Generated by Tools

A recommendation generated by a calculator, diagnostic, algorithm or AI assistant should be reviewed before implementation.

The tool may not know:

  • budget;

  • internal constraints;

  • legal requirements;

  • sector risk;

  • contractual dependencies;

  • or the organisation’s full circumstances.

External Websites and Third Parties

86. External Links

BhavPro content may link to external websites.

A link does not automatically mean:

  • endorsement;

  • partnership;

  • verification;

  • or responsibility for the external site’s content.

Third-party information can change after we link to it.

87. Third-Party Product References

References to:

  • Google;

  • Meta;

  • Facebook;

  • Instagram;

  • Microsoft;

  • Bing;

  • LinkedIn;

  • Stripe;

  • WordPress;

  • or another provider

do not imply sponsorship, endorsement or affiliation unless expressly stated.

Trademarks remain the property of their respective owners.

88. Third-Party Terms

Using a third-party service may require acceptance of the provider’s own terms.

BhavPro’s Terms do not replace those provider terms.

89. Third-Party Changes

A third party may change:

  • pricing;

  • availability;

  • terms;

  • APIs;

  • algorithms;

  • privacy controls;

  • account requirements;

  • or product features.

Information on BhavPro.com can therefore become outdated even where it was accurate when published.

Website Content

90. Accuracy

BhavPro aims to keep public information accurate and useful.

However, we do not warrant that every page is:

  • error-free;

  • complete;

  • current;

  • or suitable for every purpose.

If you believe information is materially inaccurate, please contact us.

91. Availability

We may:

  • update;

  • withdraw;

  • reorganise;

  • or remove website content.

A public page is not guaranteed to remain available indefinitely.

92. Prices

Where a public page states a price, the page should be read together with:

  • its scope;

  • exclusions;

  • tax information;

  • contract term;

  • and compulsory charges.

A price may change before a Contract is formed.

Once a Contract is formed, the applicable Order Documents govern the agreed price.

93. “From” Prices

A “from” price indicates that at least a qualifying version of the service may be available at or from that amount, subject to the applicable scope and conditions.

It does not mean every project or customer qualifies for that price.

A final quotation may be higher where requirements differ.

94. Availability of Offers

Promotions, offers or packages may be:

  • time-limited;

  • capacity-limited;

  • eligibility-limited;

  • or subject to stated conditions.

An expired offer is not guaranteed to remain available merely because a cached or archived page still exists.

Intellectual Property and Use of Information

95. Informational Content

Unless stated otherwise, BhavPro content is protected by intellectual property law.

Information may not be copied or republished commercially without appropriate permission.

96. Templates and Examples

Templates, example clauses, marketing examples, sample workflows, prompts and checklists are illustrative.

They should be adapted and professionally reviewed where necessary.

A template is not automatically appropriate to every jurisdiction or business.

Customer Responsibilities

97. Verify Material Decisions

Before making a material decision based on BhavPro information, consider whether you need to verify:

  • factual claims;

  • financial assumptions;

  • legal interpretation;

  • technical compatibility;

  • security impact;

  • advertising policy;

  • tax;

  • or regulatory obligations.

98. Customer-Supplied Information

BhavPro recommendations can be wrong if Customer information is:

  • incomplete;

  • inaccurate;

  • outdated;

  • misleading;

  • or withheld.

Customers should notify us of material changes relevant to an engagement.

99. Implementation Risk

A technically correct recommendation can still create operational risk if implemented:

  • without testing;

  • without backup;

  • in the wrong environment;

  • without stakeholder approval;

  • or without considering dependencies.

Production changes should use appropriate change control.

No Professional Relationship From Website Use

100. Website Use Does Not Create an Engagement

Reading BhavPro content, completing a general tool, downloading a resource or viewing an advertisement does not by itself create:

  • a consultant-client relationship;

  • agency appointment;

  • fiduciary duty;

  • legal-adviser relationship;

  • accountant-client relationship;

  • or another professional engagement.

A professional engagement begins when an applicable Contract is formed.

Liability and Contract

101. Contractual Services

If BhavPro provides paid Services, liability for those Services is governed principally by:

  • the applicable Contract;

  • the BhavPro Terms and Conditions;

  • the relevant Order Documents;

  • and applicable law.

This Disclaimer does not reduce an express contractual warranty.

102. Mandatory Rights

Nothing in this Disclaimer excludes or restricts:

  • fraud liability;

  • liability for death or personal injury caused by negligence where it cannot lawfully be excluded;

  • Consumer rights that cannot lawfully be excluded;

  • or another liability that the law does not permit us to exclude.

103. Reasonable Reliance

For free or public information not supplied under a specific professional engagement, you are responsible for assessing whether it is appropriate for your circumstances.

BhavPro is not responsible for a loss caused solely by treating general illustrative information as bespoke professional advice where the context clearly indicated otherwise, subject always to applicable law.

Privacy and Tracking

104. Privacy

Personal data is handled in accordance with the BhavPro Privacy Policy.

105. Cookies and Advertising Technologies

Cookies, pixels, tags and similar technologies are governed by the BhavPro Cookies, Tracking & Advertising Technologies Policy.

Advertising performance statistics may be affected when users refuse or block tracking.

106. Consent and Measurement Limitations

Privacy choices can reduce available measurement.

As a result:

  • advertising-platform figures;

  • website analytics;

  • CRM attribution;

  • and actual transactions

may not reconcile perfectly.

This does not necessarily mean the underlying system is malfunctioning.

Updates

107. Changes to This Disclaimer

BhavPro may update this Disclaimer as:

  • services change;

  • technology evolves;

  • laws change;

  • advertising platforms change;

  • AI capabilities change;

  • or new risks become relevant.

The current version and effective date are shown at the top.

Previous versions may be retained for audit and evidential purposes.
